Planning Board Meeting Minutes
December 14, 2010

7:00 PM the Planning Board meeting was called to order by D. Lindberg.

STORMWATER MANAGEMENT BY-LAW AND REGULATIONS:  The Board has a copy of the updated Stormwater Management By-law and Regulations for review.  P. Harding informed the Board that the information has been updated to meet current DEP stormwater management requirements.  The Regulations will form a Stormwater Committee consisting of town staff to review projects.  A major goal of the by-law is to ensure projects utilize acceptable erosion controls and stormwater management practices for projects not under the jurisdiction of the Planning Board and/or Conservation Commission.  Currently, construction on large lots and steep slopes often result in erosion or stormwater issues and there is no enforcement mechanism.

Dan Hazen, DPW Civil Engineer, and Jim Zingarelli, Asst. Director/Town Engineer are in attendance to aid in the review of the by-law and to answer questions.

The Nashua River Watershed Association has agreed to host a free workshop at a Planning Board/Conservation Commission meeting to review techniques that will promote Low Impact Design.  Many of the DEP stormwater changes were geared to promote this type of stormwater management.  This meeting has tentatively been scheduled for January 25, 2011.  P Harding will be inviting the Conservation Commission to also attend.

APPROVAL NOT REQUIRED

Winter Hill Road:  The applicant, Ed Jardus, is requesting approval to create two lots from one buildable lot, in an R-1 Zoning District.  Lot 7L does not have the required area.  P. Harding explained that ‘lot’ cannot be on the plan because a ‘lot’ refers to a ‘buildable’ lot.  She does not believe this ANR is entitled to endorsement.

M. Wronski motioned to deny the plan due to mislabeling ‘lot 7L’.  W. Ritter seconded.  Vote 5-0, DENIED.

ZBA RECOMMENDATION - SPECIAL PERMIT, JEFFERSON MEADOWS, LLC QUINAPOXET STREET, EXCAVATION OF SAND AND GRAVEL:  This is the site of a previous preliminary subdivision.  The applicant is applying to the Zoning Board of Appeals to excavate and remove soil within the R-1 Zoning District.  The site is approximately 30 acres.  The project will require a permit from the Conservation Commission for a wetland crossing.  There is no time limit of excavation included in the application, and it states materials will be stored on site until the occasion for its sale or use.  P. Harding believes additional information will be required from the applicant to prove this is not a quarry operation.

W. Ritter motioned for a recommendation to send a letter to the ZBA due to the fact that it appears to be commercial activity in a residential zone.  There will be a ZBA hearing January 6, 2011.  M. Wronski seconded.  Vote 5-0, all in favor to send the letter.

OTHER BUSINESS:
  • CMRPC:  P. Harding read to following statement to the Board.
CMRPC is soliciting proposals from municipalities under which we can provide technical assistance through the District Local Technical Assistance (DLDTA) Program.  This state-funded program enables regional planning commissions to provide technical assistance to our member communities for “any subject within regional planning expertise.”  This year, technical assistance will be available to help communities in the following two areas:
  • to establish partnerships among multiple municipalities, particularly focused on providing municipal services: and
  • to achieve sustainable development land use objectives, particularly focused on regional collaboration to designate and promote priority development areas and priority preservation areas.
  • Water Sewer Advisory Committee:  Would like to meet with the Planning Board to discuss some issues.
  • Open Space and Recreation Plan is still in draft form, the Committee has been unable to meet with a quorum present.
  • Visions for Holden’s Main Street:  This is a brochure from years ago.  O. Lies distributed copies to the Board for review.
  • Wind Energy:  CMRPC is having a panel discussion on wind energy on January 13, 2011.  The Wind Energy Bill did not pass in the House, to take away local authority.
W. Ritter recused himself at 7:50 PM from the Walgreens discussion.

REVIEW OF WALGREENS TRAFFIC REPORT AND CONDITIONS OF APPROVAL:  No response to the violation letter of the lighting conditions has been received.  Response has been very slow.  The Traffic and Circulation Committee reviewed the status report at their November 4, 2010, meeting.

Walgreens can be brought in for a Public Hearing and a review of the conditions, and their Special Permit could be revoked.  M. Wronski recommended no action at this time.

M. Wronski excused himself from the meeting at 7:55 PM.

J. Head motioned to adjourn.  O. Lies seconded.  All in favor.
